IN NO EVENT SHALL FRAXXIOM’S TOTAL LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNT PAID BY THE USER TO FRAXXIOM IN CONNECTION WITH THE SERVICES, WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Fraxxiom and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or relating to:

  • Your violation of these Terms
  • Your violation of applicable law or third-party rights

Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in New York, New York.

Continued use of the Services after changes constitutes acceptance of the revised Terms.
